The Reason (‘Illat) of Frequent Contact (Al-Ṭauf) and Its Jurisprudential Applications

Abstract in English:
While teaching the subject of ‘illat-reason to doctoral students in jurisprudence, I noticed the difficulty that they faced when studying the Usul Al-Fiqh, and the best method was the applied research approach. The number of ‘illat known to the students was very few, therefore, I decided to start providing applied studies of ‘illat in Usul al-Fiqh to expose a big number of the ‘illat and to simplify the understanding of Usul al-Fiqh, especially in Qiyas-analogy in which the focus is on the illat. For that purpose. I presented several studies on my own, as a supervisor or as an advisor to my students. During the study, I found issues of ‘illat (reason) of frequent contact-al-Tauf as discussed in books of Usul Fiqh by Al-Shashi and Al-Talwih by Al-Taftazani. As such, I collected materials related to this topic by defining the ‘illat and explaining the evidence for its legitimacy, its characteristics, models applied to it, such as used water (su’r) of home-occupant animals, leaving the permission of the children and the guardian at times other than the three times, and it included eating with the orphan. All these conditions and applications showed that the Shariah gave attention to the objective of removing difficulties and it revealed the interrelationship between the legal reasoning and the objectives of Shariah.

أثناء تدريس لمادة العلة لطلبة الدكتوراه في الفقه لاحظت الصعوبة التي يعاني منها الطلاب عند دراسة علم أصول الفقه وكان أجود أسلوب هو المنهج التطبيقي وأن عدد العلل التي يعرفها الطلاب قليل جدا لذا آثرت البدء بتقديم دراسات تطبيقية للعلل الفقهية للكشف عن الكم الهائل لها ولتبسيط فهما علم أصول الفقه وبخاصة القياس ومحوره العلة وقدمت عددا من الدراسات منفردا ومشرفا أو ناصحا لطلابي .ولفت انتباهي لعلة الطوف الشاشي في أصوله والتفتازاني في تلويحه. فجمعت هذه المادة العلمية معرفا بالعلة ومبينا أدلة مشروعيتها وصفاتها ونماذج تطبيقية عليها كسؤر سواكن البيوت وترك الاستئذان للأطفال والموالي في غير الأوقات الثلاثة وألحقت بها الأكل مع اليتيم. فقررت هذه الصور والتطبيقات عناية الشريعة بمقصد رفع الحرج وكشفت عن الترابط بين التعليل الشرعي والتقصيد الشرعي.
