Grounds for Challenging Arbitration Awards in Intellectual Property Disputes: A Comparison Between UAE Law and The TRIPS Agreement

This research addresses the grounds for appealing arbitration awards in intellectual property disputes under UAE law and the TRIPS Agreement, a crucial legal topic given the increasing use of arbitration as an alternative dispute resolution method. The research problem lies in the extent to which the UAE legislator reconciles the principle of the finality of arbitral awards with ensuring justice, and the degree to which the regulations governing grounds for appeal align with the requirements of the TRIPS Agreement. The research aims to clarify the legislative framework for arbitration in the UAE, analyze the grounds for appealing arbitral awards, examine the review mechanisms within the TRIPS Agreement, and identify points of convergence and divergence between the two systems. The research employs a comparative analytical approach, analyzing the provisions of Federal Law No. (6) of 2018 and comparing them with the provisions of the TRIPS Agreement, while also utilizing descriptive and inductive methods. The study focuses on the grounds for appealing arbitration awards related to intellectual property disputes within both the UAE and international legal frameworks. The research concludes that the UAE legislator has narrowed the grounds for appeal to enhance the stability of awards and the independence of arbitration, while maintaining limited judicial oversight to ensure the validity of the procedures. The research also revealed that the TRIPS Agreement employs an institutional legal review system that differs from traditional judicial appeals, while both systems share a common goal of balancing justice and the finality of decisions. The research recommended developing Emirati jurisprudence in the field of arbitration, enhancing legal awareness of appeal procedures, and supporting comparative studies and international cooperation in this area.
الملخص
يتناول هذا البحث موضوع أسباب الطعن في حكم التحكيم في منازعات الملكية الفكرية في القانون الإماراتي واتفاقية تريبس، باعتباره من الموضوعات القانونية المهمة في ظل التوسع في استخدام التحكيم كوسيلة بديلة لتسوية المنازعات. وتتمثل إشكالية البحث في مدى توفيق المشرّع الإماراتي بين مبدأ نهائية الحكم التحكيمي وضمان العدالة، ومدى توافق تنظيم أسباب الطعن مع متطلبات اتفاقية تريبس. ويهدف البحث إلى بيان الإطار التشريعي للتحكيم في الإمارات، وتحليل أسباب الطعن في الأحكام التحكيمية، ودراسة آليات المراجعة في اتفاقية تريبس، وبيان أوجه التوافق والاختلاف بين النظامين. واعتمد البحث على المنهج التحليلي المقارن من خلال تحليل نصوص القانون الاتحادي رقم (6) لسنة 2018 ومقارنتها بأحكام اتفاقية تريبس، مع الاستفادة من المنهج الوصفي والاستقرائي. وانحصر نطاق الدراسة في أسباب الطعن في أحكام التحكيم المتعلقة بمنازعات الملكية الفكرية ضمن الإطار الإماراتي والدولي. وتوصل البحث إلى أن المشرّع الإماراتي حصر أسباب الطعن في نطاق ضيق بهدف تعزيز استقرار الأحكام واستقلال التحكيم، مع الإبقاء على رقابة قضائية محدودة لضمان صحة الإجراءات. كما تبين أن اتفاقية تريبس تعتمد نظام مراجعة قانونية مؤسسية يختلف عن الطعن القضائي التقليدي، مع وجود تقارب بين النظامين في تحقيق التوازن بين العدالة ونهائية القرارات. وأوصى البحث بتطوير الفقه القضائي الإماراتي في مجال التحكيم، وتعزيز الوعي القانوني بضوابط الطعن، ودعم الدراسات المقارنة والتعاون الدولي في هذا المجال.
